TERMS AND CONDITIONS

PREMISE

 

Terms and conditions are important part of a travel agreement, but they serve to give clear guidelines to both the client and the service provider to deal with any incomprehension or problem. We therefore ask you to read this document carefully, and if any question, please ask us for clarification. Who is well informed and aware, travels better and is better protected.

PREMISE

We apply and abide to the travel laws of each county of travel/tour and based on the International Travel Convention signed on April 13, 1970 in Bruxelles (Belgium). We do accept the travel law of our clients residence countries i.e. the European Union as long as they are not in contravention to the local law of the country where the service is done. In cases where no local regulation exists, EU travel guidelines and law may apply.
The present terms and conditions have effect as soon any person, entity or company takes services from Navyo Nepal for himself, herself or on behalf of other persons for whom it reserves services offered by Navyo Nepal.

BOOKINGS

1) Client is, whoin his and others name or/and other persons effects a reservation or confirmation or a contract with Navyo Nepal. The reservation/confirmation has to be effected through the form provided by Navyo Nepal and has to be filled in all parts. Any reservation/confirmation by the client is only confirmed after Navyo Nepal confirms in written to the client.
2) The client has at the moment of the reservation/confirmation to inform on any eventual changes, which might be accepted, provided they are logistically and legally possible. We advise to book as early as possible to ensure availability of the services and however within 60 days prior arrival. No services offered are guaranteed before a booking and confirmation by us.
3) Bookings for group tours or join in tours are to be made accordingly to the single offer..
4) The client assures to send timely all required documentation like passport details, passport and/or insurance copies using the forms provided by Navyo Nepal. For some tours, the client has to hand over original documents such as passports temporarily to us for processing permits or visas and if required cash payments upon arrival if foreseen such in the tour requirements.
5) The definitive confirmation is intended concluded only after receiving the complete payment received in our bank account. Any payment missing has to be eventually paid on arrival in cash. Bank expenses of any kind except our own bank expenses have to be born by the client.

PAYMENTS

1) The quotes of each offer are intended per person and in the currency stated in the quotes and bills. The client may ask for billing in other currency but can’t enforce it upon Navyo Nepal. Exchanges rates in such cases are defined by Navyo Nepal.
2) If not otherwise accorded in written, the advance amount of around 25% of the total amount due has to be paid within 3 working days from receiving the confirmation-bill or according to the written payment schedule on the bill. The client has to inform and send a copy for each effected payment. In the same way the balance payment is done within 20 days prior to arrival latest. Any confirmation within 30 days prior to arrival has to be paid fully in one payment.
3) All bank transfer charges, including of eventual “intermediate” banks are to be borne by the client. Eventual local bank expenses of Navyo Nepal’s own bank are borne by Navyo Nepal. Only effectively accredited amounts are considered paid. In case of differences, missing amounts are payable with the second payment or upon arrival as per instructions by Navyo Nepal. The guarantee to execute confirmed services is subject to complete payment in accordance to the confirmation-bill provided.
4) Navyo Nepal reserves the right to cancel single or all services whenever payments are not completed by the client at any time.

REGRESS & CANCELLATIONS

1) Each confirmed client can at any point cancel his participation or substitute with another person if this is logistically possible and accorded by Navyo Nepal in written. The client has to bear however any cost in connection. Substitutions can’t be enforced however on Navyo Nepal the which will try to at its best possible in regard.
2) Before commencing the tour the client can renounce at any given moment. We recommend to inform us at the earliest possible moment in written by email with confirmation. We apply follow penalties for reimbursement, excluding expenses for bank transfer, permits and visa costs and penalties applied be third party service providers (i.e. such as hotels, airlines etc.) :

30 days prior arrival: only eventual bank transfer charges, government fees/permits and flight cancellation fees
29 to 21 days prior arrival: 10 % of the tour cost
20 to 16 days prior arrival: 20 % of the tour cost
15 to 08 days prior arrival: 30 % of the tour cost
07 a 03 days prior arrival: 75 % of the tour cost
02 a 01 days prior arrival: 90 % of the tour cost
No show: 100 % of the tour cost

3) Group or join in tours have penalties as below. As other participants can’t bear extra cost due to cancellation of a participant, after 30 days prior to departure we can’t entertain any refund.

Before 50 days of arrival: bank expenses, cancellation charges of airline, hotels and already issued government permits/visas etc
49 a 41 before arrival date: 30 % of the tour cost
40 a 31 before arrival date: 50 % of the tour cost
30 a 0 before arrival date: 100 % of the tour cost
No show: 100 % of the tour cost

4) Excluded from any refund are government permits, visa, climbing fees or flight tickets acquired on behalf of the client.
5) Navyo Nepal reserves the right to cancel any tour within 21 days prior to arrival due to circumstances beyond control of Navyo Nepal such as flight or transport cancellations, strikes, natural disasters, war, insurgencies, coup d’etat or higher force or group size problems. In such cases Navyo Nepal might offer an alternative tour, refund sums already paid. The client has the right to decline alternative tour offer. Other rights or claims by the client are excluded.

RESPONSABILITY

1) Navyo Nepal is responsible according to professional standards to ensure the services are executed as per offer and that the descriptions of them are correct and that eventual service suppliers (hotels, flights etc.) engaged by Navyo Nepal are controlled and valid for the period of travel. We decline however any responsibility for missing single services for which we reasonably could not foresee problems such as missing visits due to closure of sights, strikes, natural disasters and so on.
2) Each participant has to have all documents in order such as passports for the countries visited and the passports must be valid at least 6 months beyond the period of stay in the country/countries. He is responsible for obtaining all necessary health certificates if required. The client is responsible to take care of as normal viewed precautions and behavior in the visited country and to follow its laws and regulations, to follow all respective indications by the tour organizer to avoid legal or other problems. The organizer can’t be held responsible for any consequences for the client due to non-observation of them.
3) Participation to any tour/travel/activity organized by Navyo Nepal is on the basis of self responsibility of the participant. Each participant participates on his own risk on each activity to which he adheres.
4) Navyo Nepal does not include any insurance for any client/participant who travel on their own responsibility and risk. It is therefore highly advised to procure adequate insurance cover for the whole period of travel including helicopter evacuation/rescue/search, medical and accident, travel, flight, cancellation and baggage insurance for instance. Especially sport activities such as trekking, climbing, mountain bike, paragliding, rafting, bungee jump and similar must be considered. Some travel/tour reuires by local law that all participants must be adequate insured and respective copy of insurance must be send at least 14 days prior to arrival/begin of tour send to us.

CHANGES IN TRAVEL ITINERARY

1) Any changes of itinerary are subject to approval by Navyo Nepal. Changes required by logistical circumstances might procure expenses which the client has to borne. The client recognizes the right to Navyo Nepal to change overnight (hotels/Guest Houses) or other services if circumstances arising require such and those imputable to Navyo Nepal. It is understood, that in such cases the changes are done in equivalent services if possible.
2) If the client would like to change services, this can be arranged free of cost before confirming any service if due to clients flight schedule changes and one free of cost for the travel itself. Any further change might be subject to working cost of US $ 20 per person and change requested.
3) If the client would like to change services after confirming any service and those accepted by Navyo Nepal they are subject to working cost of US $ 20 per person and change requested and eventual operating costs (i.e. for hotel upgrades etc.).
4) After commencing any service, any requested change of service, if accepted by Navyo Nepal, is subject to working cost of US $ 20 per person and change and any operating cost for the change. Services cancelled or not executed due to this changes requested by client are not refundable. Eventually costs might be subject to direct cash payment on the spot. Accompanying personnel like guides, drivers are not allowed to make any change in services on request of the client if not in written authorized by Navyo Nepal.

COMPLAINTS AND DISPUTES

1) Each missing service, below accorded service standard as per contract and service offer must be reclaimed by the client according to international use and right immediately to the accompanying personnel and Navyo Nepal office in order to be corrected/resolved immediately if possible. For this purpose, Navyo Nepal provides 24 hours active phone assistance.
2) In case the client is not satisfied by the response to his complaint, he has to effect written complaint through letter to be send by postal service and with reconfirmation of receipt to the organizer (i.e. Navyo Nepal) within and not beyond 10 days of ending the services (travel) or after returning “home”.
3) Navyo Nepal recognizes as interest reprehensive of the client beyond the normal legal ways (tourist police, local Tourism authorities, lawyers etc.) also his diplomatic representation (i.e., his Embassy, Consulate) to mediate eventually disputes with Navyo Nepal

AUTORITY

The client has no right to ask without prior written consent from Navyo Nepal to its personnel or accompanying staff any change of itinerary or services. The accompanying staff and personnel has no right to accept any request of change in service or itinerary. For urgent changes in services or itinerary the client has to call our 24 hours service numbers.
Changes in single or more clauses of this contract are nil if not confirmed in written or via email by Navyo Nepal.
